Geotechnical Engineering Modelling Software (GEMS) LLP ("GEMS", "GEMSai", "we," "us," or "our") operates the https://www.gemsoftware.ai website (the "Service").
This page is used to inform website visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decides to use our Service, the Geotechnical Engineering Modelling Software (GEMS) website. It also covers our desktop applications, GEMS Cloud and the AI features in our applications, as described in Our Software, GEMS Cloud and GEMS AI.
If you choose to use our Service, then you agree to the collection and use of information in accordance with this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.
The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at https://www.gemsoftware.ai/termsandconditions.html, unless otherwise defined in this Privacy Policy.
For a better experience while using our Service, we may ask you to provide certain personally identifiable information, including but not limited to your name, email address, phone number, and postal address. 'Personal Information' means information that identifies, relates to, or could reasonably be linked with you. We use this information to provide and improve the Service, to contact you about your account or the Service, and to respond to your inquiries. We will not sell your personal information.
When you request a trial, request an estimate, create a GEMS Cloud account or contact us, we keep the details you give us in our customer relationship management system (Zoho CRM) and our database in GEMS cloud, together with the application and platform you asked for, the dates of your requests, and the approximate location (city and country) of the IP address you used. We use this to send you the software, manage your licence and trial, answer your questions, and keep you informed about GEMS products. If you tick "Remember me" on any of our forms, your browser keeps a registration reference so you do not have to fill the form in again; it holds no personal details.
Our desktop applications. When you register or license our software, we process your name, email address and organisation, your registration and licence details, and an identifier for the computer the software is installed on, so that we can activate your software, manage your licences and prevent misuse. For some types of paid licence, our licensing provider wyDay LLC keeps your name, email address, organisation and licence details; we manage all other licences ourselves. Our desktop applications do not send us analytics, usage statistics or crash reports.
GEMS Cloud. GEMS Cloud stores your account details and the projects and files you create, so that you can work with them from your browser. If you do not sign in to GEMS Cloud for one year, we may delete your GEMS Cloud data and project files.
GEMS AI. The AI features in our applications are provided using OpenAI. When you use them, the text you enter and information from your project, including the input parameters and results of your analysis runs, are sent to OpenAI for processing so that the AI features can assist you. OpenAI processes this on our behalf to provide the feature and, under its terms for business customers, does not use it to train its models. We keep logs of these requests for 60 days.
Like most websites, our web servers record each request they receive: your IP address, the date and time, the page or file requested, the page that linked to it, and your browser and operating system. We use these logs to run our services, diagnose problems and protect them against misuse and attacks, and we keep them for 60 days.
Cookies are small files that a website stores in your browser. Some of them are needed for the website to work; others let us, or the services we use, recognise your browser when you come back, which means they can be used as unique identifiers.

When you play one of our videos, it is shown from youtube-nocookie.com, and YouTube may store information in your browser once the video starts. Our blog and GEMS Cloud may set their own essential cookies, such as a sign-in session.
Your choices. If you are in the European Economic Area, the United Kingdom or Switzerland, we ask for your consent before using analytics and advertising cookies, and Google Analytics does not run until you accept. Elsewhere, we use them unless you tell us not to. Wherever you are, you can accept or reject analytics and advertising cookies, or change your mind, at any time using the Cookie Settings link at the bottom of our website’s pages, or open your cookie settings here; rejecting removes our Google Analytics cookies from your browser. We treat a Global Privacy Control signal from your browser as an objection to advertising cookies. You can also set your browser to refuse or delete cookies; if you block essential cookies, some parts of our website may not work.
We use Google Analytics, a service of Google LLC, to understand how visitors find and use our website: which pages they view, how they arrived (for example from a search engine, a social media post or one of our emails), which links and buttons they use, and whether they go on to request a trial, request an estimate, create a GEMS Cloud account or contact us. Google Analytics receives your IP address, browser and device details, and an identifier stored in the _ga cookie. We do not send your name, email address, phone number or the contents of our forms to Google Analytics.
Linking analytics with your registration. When you request a trial or create a GEMS Cloud account, we keep your Google Analytics identifier with your registration, so that we can see which of our pages and campaigns lead to estimates and purchases. We do not send your name or email address to Google. If you have not consented to analytics cookies, or have rejected them, nothing is linked. To have the identifier removed from your registration, email us at support@gemsoftware.ai.
Google signals and advertising. We use Google Analytics advertising features, including Google signals, which let Google give us reports across devices and build audiences for our Google advertising from visitors who are signed in to a Google account and have allowed ad personalisation.
Google processes this information under its own privacy policy, described at How Google uses information from sites or apps that use our services. Besides our Cookie Settings, you can opt out of Google Analytics on all websites with the Google Analytics Opt-out Browser Add-on, and manage the advertisements Google shows you at My Ad Center.

We want to inform our users that these Service Providers have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
As of the Effective Date, we engage the following Service Providers with respect to Personal Information (including without limitation): Google LLC, PayPal Holdings Inc., wyDay LLC, RazorPay, Zoho Corporation Pvt. Ltd., OpenAI. We will update this list from time to time as our Service Providers change.
Google LLC provides cloud hosting for our services, and provides Google Analytics and Google Ads (see Analytics and Advertising). Razorpay processes payments in India, and PayPal processes international payments; we do not see or store your card or bank details. Zoho Corporation Pvt. Ltd. provides our CRM and live chat. wyDay LLC provides licensing for some types of paid licence, and OpenAI provides the AI features in our applications (see Our Software, GEMS Cloud and GEMS AI).
Our Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
We value your trust in providing us your Personal Information and use commercially reasonable administrative, technical, and physical safeguards to protect it. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee its absolute security. In the event of a data breach affecting your Personal Information, we will notify you and the relevant authorities as required by applicable law.
Depending on your jurisdiction, you may have rights regarding your Personal Information, including the right to access, correct, update, or request deletion of the Personal Information we hold about you; the right to object to or restrict processing; the right to data portability; and the right to withdraw consent where processing is based on consent. To exercise any of these rights, please contact us at support@gemsoftware.ai. We will respond within the timeframes required by applicable law. You also have the right to lodge a complaint with a supervisory authority in your jurisdiction.
We retain your Personal Information only for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need your Personal Information, we will securely delete or anonymize it.
Google Analytics keeps the event data linked to cookies and identifiers for 14 months, after which only aggregated reports remain. Your choice in our cookie banner is kept for 12 months, after which we ask again. GEMS Cloud data and project files may be deleted after one year without a sign-in. We keep server logs, including logs of GEMS AI requests, for 60 days.
Your Personal Information may be processed in countries other than your country of residence, including countries that may have different data-protection laws. Where required by law, we put appropriate safeguards in place (such as standard contractual clauses) to protect your Personal Information when it is transferred internationally.
Our Services do not address anyone under the age of 13. We do not knowingly collect personal identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to take the necessary actions.
We may update this Privacy Policy from time to time. We will post the updated Privacy Policy on this page and revise the "Effective Date" above. For material changes, we will provide more prominent notice (such as by email, where we have your email address, or by a notice on our Service) before the changes take effect. We encourage you to review this Privacy Policy periodically.
In this version, dated 16th October 2026, we now use Google Analytics to understand how visitors use our website, and when you request a trial or create a GEMS Cloud account we keep your Google Analytics identifier with your registration, so that we can see which of our pages and campaigns lead to trials and purchases. We have also added a cookie banner that lets you accept or reject analytics cookies, and a Cookie Settings link at the bottom of every page. We now also describe what our desktop applications, GEMS Cloud and GEMS AI collect. The new sections are Our Software, GEMS Cloud and GEMS AI, Cookies, Analytics and Advertising and Legal Basis for Processing.
